1. Introduction
Welcome to Sussex Smokehouse. These terms and conditions (“Terms”) govern your use of our website and your purchase of our products.
Who we are: Sussex Smokehouse is a small business based in Crawley Down, West Sussex, specialising in cold smoked nuts, seeds, and seasonings.

By using our website or placing an order, you agree to these Terms. If you don’t agree, please don’t use our site or place orders.
2. Products and Services
We sell cold smoked and roasted nuts and seeds, and smoked seasonings and oils. All products are handmade in small batches.
Accuracy: We work hard to ensure product descriptions, images, and ingredients are accurate. However, as our products are handmade, there may be slight variations in appearance, weight, or flavour between batches.
Availability: Products are subject to availability. We reserve the right to discontinue products or introduce new ones at any time.
Allergens: Our products contain nuts and are produced in an environment where nuts are handled. Full allergen information is provided on product pages and labels. It is your responsibility to check allergen information before purchasing.
3. Prices and Payment
Pricing: All prices are in GBP (£) and include VAT where applicable. Prices are subject to change, but changes will not affect orders already confirmed.
Minimum Order: The minimum order value is £10.
Payment: We accept payment via Stripe and PayPal. Payment is taken when you place your order.
Failed Payment: If payment fails, we’ll contact you to resolve the issue. If we can’t resolve it within a reasonable time, we may cancel your order.
We reserve the right to refuse or cancel any order at our discretion.
4. Orders and Order Acceptance
Placing an Order: When you place an order, you’ll receive an automatic order confirmation email. This confirms we’ve received your order but does not mean we’ve accepted it.
Order Acceptance: We accept your order when we dispatch it to you. At that point, a contract is formed between us.
Right to Refuse: We reserve the right to refuse or cancel any order before dispatch, including (but not limited to) cases of pricing errors, product unavailability, suspected fraud, or inability to fulfill delivery requirements.
Order Errors: If you notice an error in your order after placing it, contact us immediately at hello@sussexsmokehouse.com. We’ll do our best to help, but we can’t guarantee changes once an order is confirmed.

- Free UK delivery on orders over £20 via Royal Mail
- Free local delivery to Crawley Down addresses
- Free collection available from Crawley Down
- Standard delivery charges apply to orders under £20
Title and Risk: Title and risk in the products pass to you upon delivery.
Failed Delivery: If delivery fails due to incorrect address information you provided, or if you’re not available to accept delivery after multiple attempts, we may charge you for re-delivery costs or cancel the order.
We are not liable for delays caused by circumstances beyond our reasonable control (see Force Majeure section).
6. Returns and Refunds

Summary:
- Faulty/damaged products: We’ll replace or refund them. Contact us within 7 days of receipt.
- Unopened products: You can return them within 14 days for a refund (you pay return postage).
- Opened products: We cannot accept returns of opened food products for hygiene reasons, unless they are faulty.
Your Consumer Rights: These Terms do not affect your statutory rights under UK consumer protection law.
7. Product Quality and Food Safety
All products are made to high food safety standards and in compliance with UK food law.
Storage: Products must be stored according to the instructions on the label. Once opened, products should be kept in an airtight container and consumed within the timeframe stated.
Best Before Dates: Our products carry best before dates. These indicate quality, not safety. Products may still be safe to consume after this date, but quality may decline.
Problems: If you have any concerns about the quality or safety of a product, contact us immediately at hello@sussexsmokehouse.com. Do not consume the product.
8. Limitation of Liability
What we’re responsible for:
- We are responsible for foreseeable loss or damage caused by our breach of these Terms or our negligence.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
- We are liable for supplying products that match their description, are of satisfactory quality, and are fit for purpose.
What we’re not responsible for:
- We are not liable for losses that were not foreseeable to both parties when the contract was made.
- We are not liable for losses caused by events beyond our reasonable control (see Force Majeure).
- We are not liable for business losses (lost profits, business interruption, lost business opportunities, etc.) as we only supply to consumers.
Maximum Liability: Our total liability to you for any claim arising from these Terms or your order is limited to the amount you paid for the product(s) in question.
9. Intellectual Property
All content on our website – including text, images, logos, product photography, recipes, and design – is owned by Sussex Smokehouse or used with permission.
You may not reproduce, distribute, modify, or use our content for commercial purposes without our written permission.
Product images are for illustration purposes. Actual products may vary slightly due to the handmade nature of our production.
10. Data Protection and Privacy
We take your privacy seriously. Full details of how we collect, use, and protect your personal data can be found in our Privacy Policy.
By using our website and placing orders, you consent to our use of your data as described in the Privacy Policy.
We comply with UK GDPR and the Data Protection Act 2018.
11. Third Party Links
Our website may contain links to third-party websites (e.g., payment processors, social media, suppliers).
We are not responsible for the content, privacy practices, or terms of third-party sites. Links do not constitute endorsement.
12. Force Majeure
We are not liable for failure to perform our obligations if the failure is caused by events beyond our reasonable control, including but not limited to:
- Acts of God (extreme weather, natural disasters)
- Pandemic or epidemic
- War, terrorism, civil unrest
- Strikes or industrial action
- Supplier failure
- Transport delays
- Government action or changes in law
If a Force Majeure event prevents us from fulfilling your order for more than 30 days, we’ll contact you to discuss options, including cancellation and refund.
13. Complaints and Disputes
How to Complain: If you’re unhappy with our products or service, please contact us at hello@sussexsmokehouse.com. We’ll do our best to resolve the issue quickly and fairly.
Alternative Dispute Resolution: If we can’t resolve your complaint to your satisfaction, you may be able to use an alternative dispute resolution service. For consumer disputes, you can use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Governing Law: These Terms are governed by the laws of England and Wales.
Jurisdiction: Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
14. General Terms
Entire Agreement: These Terms, together with our Privacy Policy, Returns & Refunds Policy, and Delivery & Collection page, constitute the entire agreement between us.
Amendments: We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the site after changes constitutes acceptance of the new Terms.
Severability: If any part of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
Assignment: We may transfer our rights and obligations under these Terms to another business. You may not transfer your rights or obligations without our written consent.
No Third Party Rights: These Terms are between you and us. No third party has any right to enforce these Terms.
